Dabei wurde auch die Verwendung des sog. Facebook Like-Buttons im Lichte des Datenschutzrechtes beleuchtet. Das LG Berlin wies nun den Antrag auf eine einstweilige Verfügung zurück, weil es im Verstoß gegen Datenschutzvorschriften keinen Wettbewerbsverstoß erkannte.

Kein Wettbewerbsverstoß

Nachdem der Antragsgegner auf eine Abmahnung hin nicht die geforderte Unterlassungserklärung abgab, beantragte der Antragsteller beim LG Berlin den Erlass einer einstweiligen Verfügung.
Das Gericht konnte einen Wettbewerbsverstoß jedoch nicht erkennen, da der vorliegende Verstoß gegen die Datenschutzvorschriften (hier: § 13 TMG) keine Marktverhaltensregelung i.S.d. § 4 Nr. 11 UWG sei.
Eine solche Vorschrift muss das Marktverhalten im Interesse der Marktteilnehmer regeln, so das Gericht.

Fazit

Nun liegt die erste Entscheidung zur Verwendung des Facebook-Like-Buttons vor. Aber das soll noch keine Entwarnung sein, denn gegen diese Entscheidung können noch Rechtsmittel eingelegt werden. Außerdem müssen andere Gerichte diese Auffassung nicht unbedingt folgen.
